Terms of Service

The agreement between Bless and the organizations, staff and individual users who use the Bless Events platform.

Version 0.1Effective February 13, 2027

These Terms of Service ("Terms") are an agreement between you and company legal name ("Bless", "we", "us" or "our"), a company state company entity type. They govern your use of the Bless Events website at blessevents.com, the organization subdomains we host, and the software we provide there (together, the "Service").

You accept these Terms when you check the box or click "I agree" (or a similar button) when we ask you to, or when you use the Service. If you accept for an organization, you accept for that organization too.

Please read the "Dispute resolution" section carefully. It asks you to resolve disputes through binding individual arbitration instead of in court, and it waives class action and jury trial rights. You have 30 days to opt out, as that section explains.

Who these Terms cover

Term Meaning
Organization The nonprofit, church, school or other group that signs up for the Service and pays for it. The organization is our customer.
Account Owner The person who signs up for the organization and accepts these Terms for it.
Staff People the organization invites to manage its account, such as admins and staff members. Volunteers the organization gives access to on an event night are also Staff for these Terms.
User Anyone with a Bless login, including Staff and members, donors and registrants who create a login.
Supporter Anyone who buys a ticket, registers, bids or gives on an organization's pages. Supporters are covered by the Donor and Attendee Terms.
Customer Data The information an organization, its Staff or its Supporters put into the Service for that organization, such as contacts, households, registrations, donations, bids and answers to custom questions.

Sections marked "for organizations" apply to organizations and their Staff. Everything else applies to every User.

Accounts

Organization accounts. To use the Service for an organization, you create an organization account and choose a subdomain. You must give accurate information and keep it current.

Authority. If you accept these Terms for an organization, you confirm that you are authorized to bind it. If you are not, do not accept them. The organization is responsible for everything done under its account, including by its Staff and volunteers, and a breach of these Terms by any of them is a breach by the organization.

Individual logins. A member, donor or registrant may create a login to see registrations, orders, gifts and household details. One login can be used with more than one organization. You must be at least 18 years old to create a login.

Keeping your login safe. You are responsible for keeping your password private and for activity under your login. Tell us right away at security email if you think someone has used your account without permission. Organizations must keep Staff access limited to the people who need it and remove access when someone leaves.

Closing your login. You can ask us to close your login at any time by writing to support email.

Support access. Our staff may sign in to an organization's account to provide support, fix a problem or investigate misuse. We keep a record of that access.

Using the Service

License. While you follow these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the Service. For organizations, that right covers running your own events, ticketing, giving and auctions.

Restrictions. You may not: (a) sell, rent, sublicense or resell access to the Service; (b) copy, modify or create works based on the Service; (c) reverse engineer or try to get the source code of the Service, except where the law allows it; (d) use the Service to build a competing product; or (e) remove any copyright or other notices.

Changes to the Service. We improve the Service over time and may add, change or remove features. If we remove a feature an organization pays for in a way that materially reduces the Service, we will tell the organization in advance.

Support. Our Support and Service Policy explains how to get help. To report a security problem, see our Security and Vulnerability Disclosure policy.

Subscription and fees (for organizations)

Plans. The organization pays the subscription fee for the plan shown at signup and on the billing page in its account. The fees on those pages are part of these Terms.

Renewal. The subscription renews automatically each month, and we charge the payment method on file at the start of each monthly period, until the organization cancels.

Cancelling. The Account Owner can cancel from the billing page or by writing to support email. Cancellation takes effect at the end of the current monthly period, and the account stays active until then. We do not refund fees for a partial month.

Price changes. We may change our prices. We will tell the Account Owner by email before a new price applies to the organization's subscription. The new price takes effect at the start of the next monthly period after the notice period.

Failed payments. If a subscription payment fails, we will tell the Account Owner. If it is still unpaid after that, we may suspend the account until it is paid.

Taxes. Our fees do not include taxes. The organization pays any sales, use or similar taxes on its subscription and on the platform fee, other than taxes on our income. If the organization is tax-exempt, it must give us proof and tell us if that status changes.

Payments on your Stripe account (for organizations)

Your own Stripe account. To accept money through the Service, the organization connects its own Stripe account. Every ticket sale, donation, recurring gift and auction charge is made directly on that account. The organization is the seller and the merchant of record. Bless never holds the organization's funds.

Stripe's terms. Payment processing is provided by Stripe, not Bless. The organization must accept and follow the Stripe Connected Account Agreement and the Stripe Services Agreement. Stripe charges its own processing fees, which the organization pays. Bless is not responsible for Stripe's decisions, such as holding payouts, closing an account or rejecting a payment.

Platform fee. For each checkout on the organization's pages, Bless takes a platform fee, collected by Stripe as an application fee from the payment. The platform fee for the organization's plan is shown at signup and on the billing page.

Covering fees. The organization may let Supporters choose to cover processing charges. That choice must be optional, shown before the Supporter pays, and easy to decline. The organization is responsible for how it describes the choice.

Your responsibilities as merchant. The organization is responsible for:

  • its refund, exchange and cancellation policies, and for issuing refunds;
  • chargebacks, disputes and any fees or losses that come with them;
  • receipts and acknowledgments its Supporters need, including any statement about tax deductibility, the value of goods or services received, and quid pro quo disclosures;
  • delivering what it sells, including tickets, events and auction items;
  • the accuracy of everything it tells Supporters.

The Service sends receipts and other emails for the organization, using the content and settings the organization chooses. Bless does not give tax or legal advice.

Your fundraising and legal responsibilities (for organizations)

The organization is responsible for following every law that applies to its fundraising, events and use of the Service. This includes:

  • charitable solicitation registration in each state where it asks for gifts;
  • permits and rules for raffles, drawings, games of chance and other gaming;
  • the laws that apply to auctions, including any auctioneer licensing, sales tax on items and rules about describing items;
  • tax-exempt status, tax receipting and reporting;
  • consumer protection, privacy and email marketing laws, including giving people a way to stop marketing email and including its postal address in that email;
  • getting any notices and consents needed to collect and use Supporters' information in the Service.

Bless does not check whether an organization is registered, exempt or licensed, and does not review its events, items or appeals before they go live.

Acceptable use

You may not use the Service to:

  • raise money for an unlawful purpose, or run a raffle, game or auction that is unlawful where it is held;
  • misrepresent who you are, whether you are a registered charity or tax-exempt, how gifts will be used, or whether a gift is tax-deductible;
  • solicit gifts in a state where the law requires the organization to register and it has not;
  • add fees, charges or donations a Supporter did not choose, or hide the cost of a purchase;
  • collect information about children beyond what an event registration needs. Information about a child may only be given by the child's parent or guardian;
  • collect sensitive information in custom questions or notes, such as health records or diagnoses, Social Security numbers, government ID numbers, bank account numbers or full card numbers. Dietary and accessibility notes needed to seat and serve a guest are allowed;
  • send spam, or email people who have not agreed to hear from the organization or who have unsubscribed;
  • upload content that is unlawful, defamatory, harassing or infringes someone else's rights;
  • test, scan or probe the Service for weaknesses, or get around its security or rate limits. To report a security problem, write to security email;
  • access another organization's data or another person's account;
  • upload viruses or other harmful code, or overload the Service;
  • scrape the Service or use automated means to access it, other than tools we provide;
  • break any law, including sanctions and export laws.

We may remove content or suspend access that we reasonably believe breaks these rules.

Customer Data and privacy

Customer Data belongs to the organization. As between Bless and the organization, the organization owns and controls its Customer Data. The organization decides what it collects, why, and who on its team can see it. The organization confirms that it has the rights, notices and consents it needs for us to process its Customer Data as these Terms describe.

Data Processing Addendum. Bless processes Customer Data for the organization as its service provider, under the Data Processing Addendum. The Data Processing Addendum is part of these Terms. If it conflicts with these Terms about personal data, the Data Processing Addendum controls.

Our license to Customer Data. The organization gives Bless a non-exclusive, worldwide, royalty-free license, for as long as we hold the data, to use Customer Data only to provide, secure, support and improve the Service and as the Data Processing Addendum allows.

Aggregated data. We may combine data about how the Service is used, and Customer Data that has been de-identified and aggregated so it cannot identify any person or organization, to run, measure and improve the Service. We own that aggregated data. We will not use it to identify any person or organization.

Security. We use administrative, technical and physical safeguards designed to protect Customer Data, as described in the Data Processing Addendum. No system is perfectly secure.

Your information as a User. Bless decides how to handle the information in your login, our billing records for organizations, our marketing site and our product analytics. The Privacy Policy explains how we do that, and the Cookie Notice lists the cookies and similar tools the Service uses. The companies we share Customer Data with are listed on our Subprocessors page.

Connected accounts and third-party services

Connected accounts. The organization may choose to connect other services to the Service, such as Salesforce. When it does, it authorizes us to send Customer Data to that service and to read data from it, as the connection is set up to do. The organization confirms it is allowed to connect the account and is in good standing with that provider. That provider's own terms and privacy practices apply to the connection, and the organization is responsible for what happens to the data there.

Third-party services. The Service relies on other providers, such as Stripe for payments. We do not control those providers and are not responsible for their services, their availability or their decisions. Links to other websites are for convenience only.

Ownership and feedback

Our property. Bless and its licensors own the Service, including its software, design and documentation, and all intellectual property rights in it. These Terms give you no ownership rights. We reserve all rights not expressly given.

Your content. The organization keeps its rights in its names, logos, images and other content. It lets us host and display that content to provide the Service.

Feedback. If you send us ideas or suggestions about the Service, we may use them for any purpose without paying you or crediting you.

Publicity. We may name the organization as a customer and show its logo for that purpose. The Account Owner can ask us to stop by writing to support email.

Copyright complaints

If you think content on the Service infringes your copyright, send a notice as our Copyright Policy explains. Under that policy we remove infringing content, and we end, in appropriate circumstances, the accounts and logins of repeat infringers.

Confidentiality (for organizations)

Each party will use the other's non-public business information only to perform under these Terms and will protect it with at least reasonable care. This does not cover information that is public, already known, independently developed or lawfully received from someone else, or information a party must disclose by law (after notice, where allowed). Customer Data that is personal data is protected under the Data Processing Addendum.

Suspension and termination

By you. An organization can stop using the Service at any time by cancelling its subscription. A User can stop at any time and ask us to close their login.

By us. We may suspend or end access for an organization or User if they materially break these Terms (including the acceptable use rules), if a payment remains unpaid, if needed to protect the Service, Supporters or other customers, or if the law requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem. We may also end an organization's account for any reason with advance notice.

Exporting data. Organizations can export their data as CSV files from the Service at any time while the account is active. After an organization's account ends, it can ask for its data for deletion days days.

Deletion. After those deletion days days we delete the organization's Customer Data, except where the law requires us to keep it, records we need for billing, taxes or disputes, and copies in backups until they expire.

What survives. Sections that by their nature should continue after the Terms end will continue, including fees owed, ownership, confidentiality, disclaimers, limits of liability, indemnities and dispute resolution.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, BLESS AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT IT WILL MEET YOUR NEEDS, OR THAT ANY DATA WILL NOT BE LOST. BLESS DOES NOT GIVE LEGAL, TAX OR ACCOUNTING ADVICE. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT ALL APPLY TO YOU.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

(A) NEITHER BLESS NOR THE ORGANIZATION WILL BE LIABLE TO THE OTHER FOR LOST PROFITS, LOST DONATIONS OR REVENUE, LOST DATA, COSTS OF SUBSTITUTE SERVICES, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, EVEN IF TOLD THEY WERE POSSIBLE.

(B) EACH PARTY'S TOTAL LIABILITY TO THE OTHER FOR ALL CLAIMS ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED liability cap.

(C) BLESS'S TOTAL LIABILITY TO A USER WHO IS NOT AN ORGANIZATION WILL NOT EXCEED THE GREATER OF $50 AND THE AMOUNT THAT USER PAID BLESS IN THE SIX MONTHS BEFORE THE CLAIM.

THESE LIMITS DO NOT APPLY TO AN ORGANIZATION'S OBLIGATION TO PAY FEES, TO EITHER PARTY'S INDEMNITY OBLIGATIONS, TO A BREACH OF THE ACCEPTABLE USE RULES, OR TO A PARTY'S GROSS NEGLIGENCE, FRAUD OR WILLFUL MISCONDUCT. MORE THAN ONE CLAIM DOES NOT RAISE THE LIMIT.

Indemnities

By the organization. The organization will defend Bless and its officers, employees and agents against any third-party claim, and pay the resulting losses, costs and reasonable attorneys' fees, arising from: (a) its fundraising, events, raffles, auctions and items; (b) its Customer Data and content, and its collection and use of Supporters' information; (c) its refunds, chargebacks, receipts and statements about tax deductibility; (d) its breach of these Terms or of the law; or (e) its agreements with Stripe, Salesforce or any other connected account provider.

By Bless. Bless will defend the organization against any third-party claim that the Service, used as these Terms allow, infringes a United States patent, copyright or trademark or misappropriates a trade secret, and pay the resulting losses, costs and reasonable attorneys' fees. If that happens, we may get the organization the right to keep using the Service, change the Service so it no longer infringes, or end the subscription and refund fees the organization prepaid for the time after the end. We have no duty for claims caused by content or data the organization supplied, by a combination with something we did not provide, or by use that breaks these Terms. This paragraph is the organization's only remedy for infringement claims.

By Users. A User who is not acting for an organization will defend Bless against third-party claims arising from that User's breach of these Terms or of the law.

How it works. The party asking for defense must tell the other party promptly, let it control the defense and settlement, and cooperate. The defending party may not settle a claim in a way that admits fault for, or imposes an obligation on, the other party without that party's written consent.

Dispute resolution

Please read this section carefully. It affects your right to go to court and to a jury trial.

Talk to us first. Before starting arbitration, the party with a dispute must send the other a written notice describing it. Our address for notices is legal email or company address. Within 45 days of the notice, the parties will meet by phone or video in good faith to try to resolve it. If it is not resolved within 60 days of the notice, either party may start arbitration.

Arbitration. Except as described below, you and Bless agree to resolve any dispute arising from these Terms or the Service through binding individual arbitration, not in court. This includes disputes that arose before you accepted these Terms. Arbitration will be run by arbitration provider under its rules then in effect. Unless the parties agree otherwise, a User who is not acting for an organization may hold the arbitration in the county where they live. The arbitrator may award the same relief a court could, but only for the individual party. The award is final and may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court for an injunction to protect its intellectual property or the security of the Service.

Who decides. The arbitrator decides questions about the scope and enforceability of this section, except that a court decides challenges to the class action waiver, disputes about arbitration fees, and whether the "talk to us first" step was completed.

No jury trial. YOU AND BLESS WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY FOR ALL CLAIMS COVERED BY THIS SECTION.

No class actions. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS. NEITHER YOU NOR BLESS MAY BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. If a court finds this waiver unenforceable for a claim, that claim will be decided by a court as set out in "Governing law and venue", and all other claims stay in arbitration.

Fees. Each party pays its own attorneys' fees, unless the arbitrator finds a claim was frivolous or brought for an improper purpose, or the law provides otherwise.

Mass filings. If 100 or more similar arbitration demands are filed against Bless within 30 days by the same law firm or coordinated group, they will be grouped in batches of 100, with one arbitrator and one set of fees for each batch.

Opting out. You may opt out of this section within 30 days of first accepting these Terms by writing to legal email or company address. Include your name, your email address or organization, and a clear statement that you want to opt out. Opting out does not change the rest of these Terms.

Severability. If part of this section is found invalid, it will be changed only as much as needed to make it enforceable, and the rest stays in effect.

Governing law and venue

These Terms are governed by the laws of the State of governing law state and the Federal Arbitration Act, without regard to conflict of law rules. For any claim not subject to arbitration, you and Bless agree to the exclusive jurisdiction of the state and federal courts in venue county, governing law state.

State notices

California. The Service is provided by company legal name, company address. To file a complaint about the Service or get more information, write to us at that address or at legal email. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.

Privacy rights. Depending on where you live, you may have rights over your personal information. The Privacy Policy explains them and how to use them. If your information was collected by an organization using the Service, contact that organization first.

Changes to these Terms

We may update these Terms. If a change is material, we will tell Account Owners and Users by email or by a notice in the Service before it takes effect. The date at the top shows when these Terms last changed. If you keep using the Service after a change takes effect, you accept the updated Terms. If an organization does not accept a change, it may cancel its subscription before the change takes effect.

Accessibility

We aim for the Service to meet the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. Our Accessibility Statement explains what we do and how to report a barrier. You can also write to accessibility email.

General

Electronic notices. You agree to receive notices from us by email or in the Service. We send organization notices to the Account Owner's email address. Those notices meet any legal need for written notice. Send notices to us at legal email.

Entire agreement. These Terms, the Data Processing Addendum and the policies they link to are the whole agreement between you and Bless about the Service. If an organization signs a separate written agreement with us, that agreement controls where it says so.

Assignment. You may not transfer these Terms without our written consent. Either party may transfer them as part of a merger, acquisition or sale of most of its assets. We may otherwise transfer them with notice.

Force majeure. Neither party is responsible for a delay or failure, other than paying money owed, caused by events beyond its reasonable control, such as a natural disaster, outage of a hosting or payment provider, war, strike or government action.

Relationship. Bless and the organization are independent contractors. Neither is the other's agent, partner or employer.

Export. You may not use or export the Service in breach of United States export or sanctions laws.

Other terms. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a term, we have not waived it. "Including" means "including without limitation." Headings are for convenience only.
